Who needs an RIA licence

Which businesses require an RIA licence?
Businesses whose primary activity is not insurance but take part in the selling of insurance incidentally to their ordinary business operations, are required to obtain an RIA licence. The types of businesses eligible for an RIA licence are listed here.

What if my business type is not included in the types of businesses that are eligible for an RIA licence?
The RIA licence only applies to non-insurance businesses that are offering insurance products in addition to their usual business listed in the regulation.

Do powersport dealerships require an RIA licence?
Under the regulation, all motor dealers qualify for licensure.

Getting an RIA licence

How does an RIA licence work?
Eligible businesses that are interested in selling insurance listed in the regulation are required to obtain an RIA licence and must meet the ongoing requirements for that licence. Under the licence, the business must assign a Designated Representative (DR) to act on behalf of and oversee insurance activities of the company to ensure compliance with regulatory requirements. The DR must be an officer, director, partner or sole proprietor of said company and is responsible for understanding their duties as a DR, which includes completing a DR course provided by the Insurance Council. Employees acting as insurance sales representatives are also expected to take courses related to the insurance products they are selling that is Insurance Council accredited.

When do I need to take the DR course?
Appointed DRs should take the course as part of the RIA licence application process.

Does the DR need to be onsite where insurance activities take place?
The regulation does not specify where the DR must be located, however, they are expected to ensure that the business and its employees are properly supervised and operate in accordance with the conditions of the RIA licence.

When do I need to obtain an RIA licence?
The Restricted Insurance Agent Licence Regulation comes into effect on January 1, 2027, and specifies “classes of persons” (the types of businesses) that require an RIA licence to sell designated insurance products listed by the regulation. Businesses that have been conducting incidental sales of insurance under the previous exemptions will need to submit an application for the new restricted insurance agency licence by March 31, 2027, in order to continue to sell insurance. Learn more here.

What can businesses do to prepare for the Restricted Insurance Agent Licence Regulation to come into effect?

If you’ve determined that your business will need an RIA licence:

  1. Review information about the RIA licence program: what is involved, what you’ll need to do and when.
  2. Assess your business’s ability to meet RIA licence qualification and ongoing licensing requirements.
  3. Review and prepare business information and required qualification steps for licence application when detailed information about this process becomes available.
  4. Apply for the licence when it becomes available.

How much does an RIA licence cost?
There will be an application fee for the RIA licence, and the RIA licence holder will be required to appoint a Designated Representative (DR) who will need to take a mandatory course. These fees are being determined as the Insurance Council evaluates different fee models suitable for the RIA licence. Like all insurance licences, there will also be an annual licence renewal fee.

Existing insurance licence holders

Do holders of a restricted travel insurance agency licence need to obtain an RIA licence?
Yes. The restricted travel insurance agency licence will be discontinued after December 31, 2027, and former holders of this licence will no longer be permitted to conduct insurance business. Travel agencies that want to continue selling insurance will need to transition to the new RIA licence. A streamlined application process for the RIA licence will be introduced for restricted travel insurance agency licensees, who will be contacted directly when information is available.

What happens to my insurance licence limited to specific products?
Licensees who hold a licence limited to specific products will be able to maintain and renew their licence but will not be able to make changes to the licence. Licensees who are eligible for an RIA licence are encouraged to transition to the new licence, while those whose primary or only business is conducting insurance or those selling types of insurance not included in the regulation are not eligible for an RIA licence.

What errors and omissions insurance (E&O) is required?
Businesses require E&O insurance for their insurance activities; some businesses may already have coverage in place and should consult their insurance provider for advice. See detailed E&O requirements here.

Where can I find Insurance Council accredited courses?
The Insurance Council RIA Accreditation Program is being finalized and further information will be provided soon. Accredited courses will be listed on the Insurance Council website.

Who needs to take RIA accredited courses?
Employees and/or agents (representatives) of an RIA licensee intending to sell insurance would be required to take RIA accredited courses related to the insurance products they are selling.

What happens if accredited training is not available for sales representatives selling insurance products by January 1, 2027?
The Insurance Council acknowledges the January 1, 2027, effective date of the Restricted Insurance Agent Regulation may not provide enough time to complete the  accreditation process.

To address this, a short-term provision for RIA licensure will be available to businesses that meet all other criteria for an RIA licence, which will allow businesses to continue insurance activities while ensuring sales representatives complete accredited training as it becomes available.

Who can apply for accreditation?
Any provider of insurance training can submit training materials to be accredited.

What is required for  accreditation?
Training must meet performance requirements that demonstrate knowledge, technical abilities and business skills for the  sale of insurance products. A complete RIA accreditation application includes course materials for review, as well as supplementary information such as a completed application form and checklist. When can I apply for RIA accreditation?
We expect to begin accepting RIA accreditation applications in 2026. We encourage training providers to review the RIA Accreditation Program Guide to ensure training materials meet performance requirements or start developing materials following the principles in the guide.

How long do courses maintain accreditation status once accredited?
Courses are accredited for a period of four years. Training providers must reapply for accreditation to maintain accreditation status. Learn more about the RIA accreditation program here.
