Who needs an RIA licence

The BC Restricted Insurance Agent Licence Regulation has implications for non-insurance businesses named in the regulation and may require action from these businesses. This applies to some non-insurance businesses that already hold a BC insurance licence.

Any business identified in the regulation that is conducting incidental sales of insurance also named in the regulation will need a restricted insurance agency licence.

Who needs an RIA licence

The BC Restricted Insurance Agent Licence Regulation identifies the types of businesses, referred to as "prescribed classes of persons" in the regulation, that will require a restricted insurance agency licence in order to sell the corresponding insurance products listed and defined in the regulation. (Shown in the table below.)

If your organization offers insurance for more than one type of business, it must hold a separate RIA licence for each business type named in the Restricted Insurance Agent Licence Regulation.

Unlicensed sales will be considered non-compliant with the Financial Institutions Act and businesses could be subject to a fine of $50,000.

Who is impacted and what’s required

Formerly exempt businesses without a BC insurance licence
Businesses selling types of insurance that were previously exempt under the Insurance Licensing Exemptions Regulation prior to January 1, 2027, and that are now included in the Restricted Insurance Agent Licence Regulation, will need to apply for a restricted insurance agency licence by March 31, 2027.

What’s required
These businesses must apply for a restricted insurance agency licence by March 31, 2027 to be able to continue selling classes of insurance now included in the regulation.

Travel agencies and wholesalers with a BC restricted travel insurance agency licence
As the type of business and products sold by restricted travel insurance agencies are included in the Restricted Insurance Agent Licence Regulation, these licensed agencies will need to transition from their current restricted travel insurance agency licence to the new RIA licence. Travel agencies and wholesalers will have the same licence requirements as the other RIA licence holders.

Under the Restricted Insurance Agent Licence Regulation, travel agencies and wholesalers will be able to add rental vehicle insurance sales under an RIA licence if their representatives have completed approved rental vehicle insurance training.

  • Those with restricted travel insurance agency licences will need to transition to the RIA licence by December 31, 2027, in order to continue selling travel insurance. After this date, the restricted travel insurance agency licence will be discontinued.
  • To transition to the RIA licence, restricted travel insurance licensees should apply for the RIA licence via the Insurance Council’s online portal when it becomes available on January 4, 2027.
  • Current restricted travel insurance licensees that apply for the RIA licence by May 31, 2027:
    • Will be exempt from the RIA licence application fee.
    • Will not be required to have sales representatives complete additional approved RIA training if they have already passed the Insurance Council-approved travel insurance exam from the Association of Canadian Travel Agencies (ACTA).
    • Will be issued a licence that expires on May 31, 2028. The annual fee for the RIA licence for 2027/2028 year will apply.
    • May choose to include sales of rental vehicle insurance to their RIA licence if their sales representatives have completed approved training for rental vehicle insurance.
When preparing to apply for the RIA licence, current restricted travel insurance licensees can:
  • Familiarize themselves with the RIA licence requirements outlined on the website, and in the more detailed Restricted Insurance Agency Guidelines once published (in December 2027).
  • Identify a designated representative who is an officer, director, partner or sole proprietor of the business and have them successfully complete the mandatory designated representative training course.
  • Review the RIA licence application materials when they become available and gather any required documentation or supporting information. When applying for the RIA licence, restricted travel licensees will need to provide:
    • Confirmation of E&O insurance form or a copy of their E&O insurance certificate.
    • Written authorization to represent an insurer, if the information displayed to them in the application is no longer current.
    • Government forms, if the governance information shown on record is no longer current.
  • Consider if they will include sales of rental vehicle insurance under the RIA licence.

Current restricted travel licence holders that have not transitioned to the RIA licence by May 31, 2027, can continue carrying out travel insurance business until December 31, 2027, if they renew their existing licence; after this date the licence will be cancelled.

Businesses with a BC insurance licence limited to the sale of specific products
Businesses and insurance types included in the regulation: Businesses with a general, life and/or accident & sickness insurance licence limited to the sale of products now covered by the Restricted Insurance Agent Licence Regulation can opt to apply for the RIA licence or retain their current licence.

Businesses and insurance types not included in the regulation: Businesses with a general, life and/or accident & sickness insurance licence limited to the sale of products that are not included in the Restricted Insurance Agent Licence Regulation are not eligible for a restricted insurance agency licence. These licence holders will be able to renew and maintain their current licence.

Businesses that act as intermediaries between insurers (including product and vehicle manufacturers) and non-insurance businesses are not eligible for an RIA licence and must have a general, life or accident & sickness licence, as applicable, to conduct insurance business.
